By using MyHealth, including this website, you signify your assent to these Terms and Conditions.

If you do not agree to all of these Terms and Conditions of use, do not use MyHealth.

Trinity Health Mid-Atlantic (“THMA,” “we,” “our,” or “us”) may revise and update these Terms and Conditions at any time and such modifications are effective immediately upon posting of the modified version. Your continued usage of MyHealth will mean you accept those changes.

Introduction

“MyHealth” is an Internet application that enables a patient (“you” or “your”) to have secure web-based access to portions of their electronic medical record at THMA. For the purposes of these Terms and Conditions, MyHealth includes the MyHealth website and all relevant parts and components thereto. MyHealth is not an attempt to practice medicine or provide specific medical advice and should not be used as a substitute for the advice of your personal physician or other qualified health care provider.

Neither MyHealth nor any other application available through MyHealth is a substitute for appropriate and timely contact with your physician. MyHealth is not a substitute for consultation with your physician. You should never change or stop any course of treatment prescribed by your physician without first consulting him or her.

You should not rely upon MyHealth if you have immediate, urgent or life-threatening health concerns or questions, but should instead seek appropriate emergency medical assistance, such as calling your doctor or 911.

Privacy

The pages on the MyHealth website are subject to THMA’s and Website Terms and Conditions. THMA will collect, access, safeguard, use or disclose your information through this portal only in accordance with applicable federal and state laws (such as HIPAA) and its internal policies and procedures, including in accordance with its Notice of Privacy Practices.

Security

The security of any data in MyHealth is very important to us. We want your personal information to remain as secure as possible. MyHealth uses encryption technology designed to help ensure the integrity and privacy of the information you provide to us. As an added security precaution, all data is kept on servers with firewalls that meet or exceed industry standards to prevent intruders from gaining access.

We review our security practices on a regular basis to help ensure that your data is maintained securely and safeguarded in accordance with all applicable laws and regulations and our own internal policies and procedures. However, no system can perfectly guard against risks of intentional intrusion or inadvertent disclosure of information. Moreover, when you transmit information via the Internet, your transmission may be compromised before it reaches us.

Accordingly, THMA makes no guarantee as to confidentiality or security of the data you submit or transmit via the Internet, including while using MyHealth. In addition, you hereby expressly and fully assume the risk of any unauthorized disclosure or intentional intrusion, or of any delay, failure, interruption or corruption of data or other information transmitted in connection with your use of MyHealth.

Disclaimer of Warranties

THMA makes no express or implied warranties as to the accuracy, timeliness, merchantability, fitness or appropriateness for a particular use, purpose, title or non-infringement concerning your use of MyHealth. There is no warranty that the information on MyHealth or THMA’s efforts will fulfill any of your particular purposes or needs. MyHealth and information contained in MyHealth are provided on an “as is” basis and the entire risk as to your reliance on information obtained from, or contained in, MyHealth are entirely on you. THMA is not responsible for errors or omissions in the information contained in MyHealth.

You acknowledge and agree that THMA does not operate or control the Internet and, therefore, cannot guarantee that the use of MyHealth will be error free or free from technology downtimes or unavailability. You further acknowledge that THMA cannot and does not guarantee against any potential loss or damage to your data or the data you transmit via MyHealth due to viruses, worms or other unauthorized users or hackers attempting to obtain access to MyHealth or information transmitted to or from MyHealth.

Limitation of Liability

The use of MyHealth is entirely at your own risk.

Except as otherwise provided in this agreement, under no circumstances shall THMA be liable to you or any third party for any damages (including, without limitation, direct, incidental, special, indirect, exemplary, punitive, consequential damages, personal injury, wrongful death or lost profits, including all fees and penalties), that arise under, result from or relate to these Terms and Conditions or the use of or inability to use MyHealth.

In the event that the applicable state law(s) prohibit a full disclaimer of damages and liability above, THMA shall be liable only to the extent of actual, direct damages incurred by you, not to exceed Five Hundred Dollars ($500). Any claims arising in connection with your use of MyHealth must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under these Terms and Conditions are exclusive and are limited to those expressly provided for in these Terms and Conditions.

Indemnification

You assume the sole risk of transmitting your information as it relates to the uses of MyHealth and for any data corruptions, intentional interceptions, intrusions or unauthorized access to information, or of any delays, interruptions to, or failures preventing the use of MyHealth. You agree to defend, indemnify, and hold THMA, its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
